Data Retention.

Your information will be retained in accordance with our data retention policy, which is designed to retain data for as long as needed or permitted in light of the purposes for which it was collected and consistent with our contractual obligations, employment obligations, and other business purposes, including global legal obligations. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide the Services to you (for example, as long as you have an account with us or keep using the Services); (ii) whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to the applicable statutes of limitation, litigation or regulatory investigations). Sale of Personal Information: We do not sell your personal information for money but we and our business partners use tracking technologies to help us to understand our customers and visitors to the Services, to enhance your online experience, and customize our offerings in ways that may be deemed a “sale” of personal information under the California Consumer Privacy Protection Act (CCPA). We do not knowingly sell the personal information of minors under 16.

In your request, please make clear what personal information you would like to have changed or whether you would like to have your personal information suppressed from our database. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the personal information provided until after the completion of such purchase or promotion).

5. Rights and Requests for California Residents or As Required By Law.

(2) “Request to delete”

You may request that we delete personal information we collected from you.

Account holders can request access to their personal information at any time by logging into their accounts on the Services. We will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the personal information subject to the request. You may make a request on behalf of a child who is under 13 years old if you are the child’s parent or legal guardian. If you make a Request to Delete, we may ask you to confirm your request before we delete your personal information.

If you want to make a Request to Know or a Request to Delete as an authorized agent on behalf of a California resident, please complete the webform in onsemi’s Privacy Rights Portal, email us at privacy@onsemi.com or call 1-800-905-4574. Account holders can request access to their personal information at any time by logging into their accounts on the Services. As part of our verification process, we may request that you provide, as applicable, proof concerning your status as an authorized agent, which also may include:

  1. Proof of your registration with the California Secretary of State to conduct business in California;
  2. Proof of a power of attorney from the resident pursuant to Probate Code sections 4121-4130.

If you are an authorized agent and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4121-4130, we may also require the resident to:

  1. Verify the resident’s own identity directly with us; or
  2. Directly confirm with us that the resident provided you permission to make the request.

(3) “Request to Opt-Out”

We offer an opt-out from the use of cookies and other tracking technologies in connection with our Services, which may in some cases constitute the sale of your personal information under the CCPA or other privacy laws. To opt-out of the sale of your personal information, please click Do Not Sell My Personal Information or fill out this webform at the ON Semi Privacy Rights Portal. This will cause information to cease to be added to any cookies or other tracking technologies that have been set on our Services or block them entirely. Please note that you will need to opt out again if you visit one of our Services from a different device or browser of if you clear your cookies.

If you want to make a Request to Opt-Out as an authorized agent on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request, as applicable:

  1. Proof of your registration with the California Secretary of State to conduct business in California;
  2. Signed permission that the resident has authorized you to make a Request to Opt-Out on the resident’s behalf. “Signed” means that the permission has either been physically signed or provided electronically in accordance with the Uniform Electronic Transactions Act, Civil Code 1633.7 et seq.

Verification: Please note, we will take steps to verify your identity before fulfilling any of the above requests. If you maintain an account with us, we will verify your identity through existing authentication practices for the account (e.g., login and password). If you are not a registered member, we will verify your identity by matching two or three data points that you provide with data points that we maintain and have determined to be reliable for the purposes of verification (e.g., browser or device ID). Please note, we will take steps to verify your identity before fulfilling any of the above requests. If you maintain an account with us, we will verify your identity through existing authentication practices for the account (e.g., login and password). If you are not a registered member, we will verify your identity by matching two or three data points that you provide with data points that we maintain and have determined to be reliable for the purposes of verification (e.g., browser or device ID).

Right to Non-Discrimination: You have the right to be free from unlawful discriminatory treatment for exercising your rights under the CCPA.

Do Not Track Signals: onsemi responds to Do Not Track signals to the extent received from a web browser.

Non-California Residents: onsemi will seek to honor requests to exercise the above rights made by non-California residents to the extent required by applicable law.

6. Communication Preferences and Marketing (Opt-out).

If you do not wish to receive marketing communications from us, you can indicate your communications preference within the direct communication from us or through your account/profile settings. You may not opt-out of administrative emails (for example, emails about your transactions or policy changes) for your registered account. We may share Personal Information with our corporate affiliates, who share our brand, for their direct marketing purposes. California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. You may email us at privacy@onsemi.com to request the number of our corporate affiliates with which we share a brand and have shared your Personal Information for their direct marketing purposes, if any.

7. Additional Choices.

If you have consented to our collection of your personal data for multiple specific purposes or explicitly consented to our collection of special/sensitive categories of personal data (i.e., personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation) your consent can be withdrawn at an any time without affecting the lawfulness of processing based on consent before its withdrawal.
